Public Reaction from D+

The Municipality of Prishtina violated the law in the €12 million contract for the “Capital City Architect Service” by appointing a person who was not part of the Municipality of Prishtina to the bid evaluation commission.

Kreshnik Ferizi, a member of the bid evaluation commission, was not part of the Municipality of Prishtina, as his contract with the municipality ended on December 31, 2022, confirmed by the Human Resources Office of the Municipality of Prishtina. The bid evaluation commission for the “Capital City Architect Service” contract completed its report and evaluation on May 29, 2023, five months after Ferizi’s engagement with the Municipality of Prishtina had ended.

The Public Procurement Regulation stipulates that contracting authorities have the right to engage external experts when specific technical knowledge and expertise are required, and such experts are not available within the contracting authority. However, Ferizi was neither engaged nor an external expert at the time he participated in the bid evaluation commission for this tender.

In addition to the illegal participation in the bid evaluation commission, there is a well-founded suspicion of a conflict of interest. The group of economic operators “Capital City Architect Service” (Ardi CC L.L.C; Anarch Sh.P.K), which was declared the winner by the evaluation commission where Ferizi was a member, submitted documentation showing Ferizi himself as an associate of the company “Anarch Sh.P.K.”

Based on this information, D+ calls on the Municipality of Prishtina to cancel this contract and for the prosecution to take action to investigate all aspects of this procurement activity, including the evaluation process, selection criteria, and any potential conflicts of interest. Ensuring transparency, accountability, and integrity in this matter is essential for maintaining public trust.
